The Supreme Court on Thursday (November 6, 2025) declined to intervene in a plea by former Uttar Pradesh MLA Mohammed Abdullah Azam Khan, son of Samajwadi Party leader Azam Khan, to quash charges of procuring a passport using forged documents.
“We are not inclined to interfere,” Justice M.M. Sundresh, who was heading the Bench, addressed senior advocate Kapil Sibal, appearing for Mr. Khan.
The Allahabad High Court had earlier refused to quash the criminal case, prompting the former MLA to approach the Supreme Court.
“The trial court is at liberty to decide all the issues without being influenced by the order of the High Court,” the Supreme Court Bench observed.
BJP MLA Akash Saxena had filed a case against Mr. Khan in Rampur on July 30, 2019, alleging fraud and violation of the Passport Act for allegedly obtaining the travel document using an incorrect date of birth.
According to the complaint, Mr. Khan was issued a passport on January 10, 2018. While the passport listed his date of birth as September 30, 1990, his educational certificates showed January 1, 1993.
The case was registered in Rampur district. Mr. Khan is facing trial before the Special MP/MLA Judge, Rampur. Charges in the case were framed on September 9, 2021.
